"An undisputed Classic" - The New York Times Book Review
"For the forensic sociologist the book will be useful, for the young attorney helpful, and for the general reader delightful." - American Sociological Review
This work has dominated its field for the past sixty years. It has taught generations of aspiring lawyers, re-energized courtroom veterans, and improved the abilities of interviewers, social workers, psychologists, and other professionals who utilise questioning in their daily work. It has also amused tens of thousands of general readers who like the trial's drama. Francis L. Wellman explains and exhibits the ideas of inquiry, drawing on his personal experiences and the remarkable achievements of notable lawyers such as Herbert C. Smyth, Lloyd Paul Stryker, George Z. Medalie, Elihu Root, and Frederic R. Coudert, among others. He draws heavily on a number of well-known instances to illustrate both the technique and content of cross examination. He accepts the challenge. He discusses how to deal with perjured witnesses and experts, emphasises the necessity of sequence, and provides many insights into witness psychology. He demonstrates how part of the lobbying artistry is knowing when to elicit information and when not to.
As an assistant corporation counsel and assistant district attorney in the musty New York courtrooms of the 1880s and 1890s, FRANCIS L. WELLMAN established himself as one of the great nineteenth-century trial lawyers. He rose to popularity as a result of his involvement in a number of well-known criminal cases, including the infamous Carlyle Harris case. He became well-known for his dramatic cross-examination of witnesses coups, but he frequently stressed that he relied on hard work and systematic preparation rather than deception. He was born in 1854, the son of Morgan Lewis, an early governor of New York, and Francis Lewis, the third vocalist of the Declaration of Independence. At the age of eighteen, he died in 1942.
