The Electronic Commerce Act 2006 (Act 658) is a Malaysian law that governs electronic commerce and regulates transactions conducted through electronic means. The Act was enacted on 1st January 2006 and came into force on 1st October 2006.

The Act defines electronic commerce as the conduct of trade, commerce, or business through electronic means. It covers various electronic transactions, including electronic contracts, electronic signatures, electronic messages, and electronic records.

Under the Act, electronic contracts are legally valid and enforceable if they meet certain requirements. These include the parties' consent to enter into the contract, the clarity and specificity of the terms and conditions, and the proper authentication and verification of the electronic contract.

The Act also provides for the use of electronic signatures in electronic transactions. It recognizes electronic signatures as legally valid and enforceable if they are reliable, unique to the signatory, and capable of identifying the signatory. The Act sets out the requirements for electronic signatures to be considered reliable, including the use of secure identification methods and ensuring the integrity and authenticity of the electronic signature.

The Act also regulates the use of electronic messages in electronic transactions. It provides that electronic messages can be used to satisfy legal requirements for written communications if they are accessible, able to be retained, and can be reproduced in a tangible form. The Act also sets out the rules for the time and place of dispatch and receipt of electronic messages.

In addition to regulating electronic transactions, the Act also provides for the establishment of a regulatory framework for electronic commerce in Malaysia. This includes the creation of a National Electronic Commerce Council and the establishment of a dispute resolution mechanism for electronic commerce disputes.

Overall, the Electronic Commerce Act 2006 (Act 658) provides a comprehensive legal framework for electronic commerce in Malaysia and helps to facilitate the growth of electronic commerce in the country.
