This book on Trade Marks and Passing Off gives readers a complete overview of the statutory requirements and principles governing trade mark registration, maintenance, and enforcement, as well as the fundamental principles governing common law passing off actions. The author has drawn on his years of expertise to provide detailed commentary on the general concepts and practise of trade mark law in Malaysia, as well as an in-depth analysis of the principles of passing off, in light of the recently adopted Trademarks Act 2019. While the new Act governs trade mark law, the Trade Marks Act 1976 continues to apply to some trade mark applications due to the Act's saving provisions. To answer this, the book includes several chapters that discuss the 1976 Act's provisions and case law developments. More importantly, the author has sought to clarify the key sections of the recently enacted Trademarks Act 2019 by referring to a number of case laws that explained similar provisions in the UK, European Union, and Singapore trade mark legislation.
