Detailed Contents of (Act 769) & (Act 770):

Two laws in Malaysia that are intended to prevent and combat terrorism are the Prevention of Terrorism Act (Act 769) and Special Measures Against Terrorism in Foreign Countries (Act 770). The laws offer a framework for the domestic and international investigation, arrest, and prosecution of suspected terrorists.

The Prevention of Terrorism Act (Act 769) and Special Measures Against Terrorism in Foreign Countries (Act 770) are summarised as follows:

  1. The Prevention of Terrorism Act (POTA), also known as Act 769, gives the government the authority to conduct preventive actions against terrorism, such as the custody and observation of suspected terrorists. According to the Act, terrorism is widely defined, and anyone accused of being involved in terrorism, including planning or preparing for terrorist activities, is subject to punishment.
  2. Act 770: Special Measures Against Terrorism in Foreign Countries: The Special Measures Against Terrorism in Foreign Countries Act (SMATA) establishes the legal grounds for prosecuting Malaysians who engage in or commit acts of terrorism abroad. The Act also enables Malaysia to request the extradition of suspected terrorists from other nations so that they can face trial there.
  3. Investigation and Detention: Under the POTA, suspected terrorists may be held without charge for up to 28 days. The Act also allows for the monitoring of communications and the confiscation of anything thought to be related to terrorism. Malaysians who are accused of participating in terrorism abroad can be investigated and prosecuted under the SMATA.
  4. Trials and Penalties: The POTA establishes special courts to hear terrorism-related charges, and the Act permits the use of classified material in such proceedings. The Act also calls for the execution of those who commit certain terrorism-related offences. The SMATA allows for the application of sanctions, such as fines and imprisonment, and it provides for the prosecution of Malaysians who engage in or commit acts of terrorism overseas.
  5. A Review Committee is in charge of monitoring the POTA and SMATA and is charged with examining how the Acts' authority has been used and providing suggestions for improvement.
