This book explores the intersection of intellectual property rights and the human rights framework, shedding light on the concept of intellectual property. By employing the plain packaging policy for tobacco products as an example, it illustrates how intellectual property rights can be regarded as a subset of human rights. The significance of this specific illustration lies in its potential applicability to other products in the future, such as alcohol, sugary beverages, children's food, and more. Consequently, the book emerges as a valuable reference on the subject of intellectual property rights as a human rights issue.

Key Features of Intellectual Property Rights & Human Rights: A Malaysian Perspective:

  • The current trending intellectual property topic worldwide is the policy regarding plain packaging.
  • This innovative use of the term "human rights," connected with "intellectual property" in the title, will capture readers' attention, prompting further exploration of the interconnection between intellectual property and human rights. This is especially relevant for individuals studying Human Rights Laws.
  • The Syariah perspective on plain packaging delves into intellectual property, considering it as a form of property that can be quantified as an asset for the distribution of faraid (Islamic law on inheritance). This information proves beneficial for students studying Syariah Law.
  • The Ministry of Health, smokers, non-smokers, consumer associations, and Malaysia's Human Rights Council are among the entities that underwent surveys and interviews for this book. As of now, these findings have not been published in any other intellectual property book.
  • Currently, there are no other legal publications in Malaysia addressing the plain packaging policy.
