An Act to provide for the conservation and preservation of National Heritage, natural heritage, tangible and intangible cultural heritage, underwater cultural heritage, tresure trove and for related matters.
Detailed Contents of National Heritage Act 2005 (Act 645):
A Malaysian law known as the National Heritage Act 2005 (Act 645) was passed in order to safeguard Malaysia's national heritage. According to the Act, "places, buildings, structures, archaeological sites, transportable artefacts, records, intangible heritage, and other similar things" that have value in terms of history, culture, or the arts are considered to be heritage.
The National Heritage Council (NHC), which is charged with recognising, protecting, and promoting Malaysia's heritage, is established by the Act. The Minister of Tourism, Arts, and Culture serves as the NHC's chair, and members of the organisation include representatives from numerous governmental departments and specialists in heritage preservation.
A permission from the Director-General of Heritage is required by the Act for anyone planning to conduct actions that could harm a heritage asset. To prevent the heritage site from being harmed or destroyed, the permit may include restrictions on the activity. A fine of up to RM500,000 or up to five years in prison, or both, are possible penalties for failing to get a permit or follow the terms of one.
The Act also creates a National Heritage Register, which compiles a list of all cultural landmarks and items covered under its protection. The record is kept up to date by the Director-General of Heritage and can be viewed by anybody.
In addition to the Act, there are rules that offer more information on how the Act is being put into practise. These regulations, which were last amended on October 15, 2012, offer guidelines on how to apply for permits, the standards for adding historical buildings and other items to the National Heritage Registry, and the consequences for breaking the Act.
It is also possible to consult the National Heritage Act of 2005's rules (Peraturan-peraturan) and the Malay version of those documents (Akta Warisan Kebangsaan 2005).
