Sabah Land Ordinance

(Chapter 68)

The Sabah Land Ordinance (Chapter 68), enacted in 1930, serves as the principal legislation governing land matters in Sabah, Malaysia. It outlines the procedures for the classification, alienation, and occupation of State lands, ensuring systematic land administration and management.

Key Provisions:

1. Government Ownership of Land:
   - All State land and land reserved for public purposes are vested solely in the government. Unlawful occupation does not confer any rights or titles to the occupier.

2. Alienation of State Land:
   - State land may be alienated to individuals, companies, or bodies corporate, subject to conditions such as rent, premium, and land use stipulated by the government.

3. Native Titles and Rights:
   - The Ordinance recognizes native customary rights and provides for the issuance of Native Titles, which are inalienable to non-natives without proper authorization.

4. Land Use and Classification:
   - Land is categorized into various classes, including Town Land and Country Land, each with specific regulations regarding use, development, and transfer.

5. Reserves and Protected Areas:
   - The government has the authority to reserve portions of land for public purposes, residential use, or as Native Reserves to protect the interests and well-being of native communities.

6. Registration and Dealings:
   - All dealings, claims, or interests in land must be registered in accordance with the provisions of the Ordinance to be considered valid.

7. Penalties for Unlawful Occupation:
   - Individuals found unlawfully occupying State land or land reserved for public or residential purposes may face fines up to one hundred thousand ringgit or imprisonment up to five years, or both.
