Issues of agency frequently arise in commercial legal practice. Now in its fifth edition, Agency: Law and Principles addresses these issues by providing a clear and accessible explanation of the foundations of agency law and the concept of agency itself. It combines detailed analysis of the latest case law with a practical perspective that reflects contemporary commercial realities, examining how agency principles apply across different categories of agents in key commercial sectors. Topics covered include actual and apparent authority, agency of necessity, sub-agency, termination of agency, lack of authority and ratification, as well as the legal relationships between principal and agent and between agent and third parties.
This edition has been thoroughly updated to incorporate important recent case law and legislation, including Supreme Court decisions such as Barton v Morris [2023] AC 684, Philipp v Barclays Bank UK Plc [2024] AC 346, and Rukhadze v Recovery Partners GP Ltd [2025] 2 WLR 529. It also introduces a new section on agency and attribution within company law. In light of the growing use of algorithmic agreements on digital platforms, the book also considers how agency law applies in this evolving context.
Clear, authoritative, and concise, this work is an essential resource for all commercial lawyers.
