When a marriage breaks down, child custody, care and access often become deeply personal and emotionally challenging concerns. Timely decisions and urgent legal applications may be necessary to safeguard the interests of those involved. Understanding how courts apply the child welfare principle, consider and rebut the tender years presumption, approach joint custody and shared care, and enforce or vary existing orders is therefore essential.
This book offers practical guidance on managing child custody matters, with the child’s welfare remaining the paramount consideration in custody, access and maintenance decisions. It examines relevant statutory provisions, summarises leading cases and discusses preventive measures against overseas relocation, including port alert orders and other enforcement remedies.
The guide also covers advocacy and case strategy, procedures from filing to judgment, responses to domestic violence, and useful checklists and drafting tips. A dedicated chapter explores mediation, collaborative practice and alternative dispute resolution as avenues for resolving custody disputes outside court.
With its detailed coverage of the legal and practical issues surrounding child custody, this book is a valuable resource for family law practitioners, counsellors, judges, parties involved in custody disputes and anyone concerned with children’s welfare following marital breakdown.
