From the Foreword by

Tan Sri Zarinah Anwar

Chairman of the Board of Directors, Universiti Malaya

Fintech Law and Regulation is a pioneering and comprehensive resource examining Malaysia’s rapidly developing financial technology landscape, with comparative perspectives from Singapore, Indonesia, and Thailand. It offers an in-depth analysis of the innovation-driven policies and risk-based regulatory approaches shaping the fintech environment across ASEAN.

Comprising nine detailed chapters, the book addresses important areas that remain underexplored in existing legal literature. It examines a wide range of regional regulatory challenges, including cross-border compliance, data protection, and anti-money laundering (AML) requirements. The book also explores emerging fintech developments such as crowdfunding and alternative fundraising, distributed ledger technology (DLT), smart contracts, decentralised autonomous organisations (DAOs), digital assets, cryptocurrency, and e-money licensing.

A distinctive feature of the book is its detailed treatment of Islamic Fintech. Drawing on Malaysia’s position as a leading jurisdiction in this field, the book compares Shariah-compliant digital financial instruments with conventional fintech models and incorporates relevant case studies from Malaysia, Singapore, and Indonesia. It also examines newer developments, including licensed digital banking consortiums and their role in promoting financial inclusion, as well as the regulatory challenges surrounding artificial intelligence applications such as robo-advisers. The final chapter considers regulatory sandboxes and their potential to provide effective solutions for governing an increasingly fragmented digital financial ecosystem.

Written to provide both comprehensive coverage and practical accessibility, this book is a valuable reference for law and finance students, academics, researchers, legal practitioners, and policymakers seeking to understand the legal and regulatory foundations of fintech and its continuing development across the ASEAN region.
