Akta Mahkamah Rendah 1948 (Akta 92) & Akta Kaedah-Kaedah Mahkamah Rendah 1955 (Akta 55) (Hingga 20hb April 2021)

The Akta Mahkamah Rendah 1948 (Act 92) and Akta Kaedah-Kaedah Mahkamah Rendah 1955 (Act 55) are two pieces of legislation that govern the proceedings of lower courts in Malaysia.

The Akta Mahkamah Rendah 1948 (Act 92) provides the framework for the establishment and jurisdiction of lower courts in Malaysia. This includes the establishment of Magistrates' Courts, Sessions Courts, and Penghulu's Courts. The Act also outlines the powers and functions of these courts, including their jurisdiction over criminal and civil cases.

The Act also provides for the appointment of judges to these courts, and sets out the qualifications and conditions of service for these judges. It also includes provisions for the conduct of court proceedings, including the procedures for the calling of witnesses, the presentation of evidence, and the sentencing of convicted persons.

The Akta Kaedah-Kaedah Mahkamah Rendah 1955 (Act 55) provides the procedural rules and guidelines for lower court proceedings. These rules cover a wide range of issues, including the service of court documents, the conduct of hearings, the filing of appeals, and the enforcement of court orders.

The Act sets out the procedures for the conduct of civil and criminal trials, including the procedures for the examination of witnesses, the presentation of evidence, and the making of judgments. It also provides for the enforcement of court orders, including the methods of execution and the recovery of costs.

Both Acts have been amended over the years to reflect changes in the legal system and to improve the efficiency of lower court proceedings. The most recent amendment to the Acts was made in April 2021.
