The term "Land Acquisition" refers to the process of the government or a government agency acquiring land from private landowners for a public purpose, with compensation provided to the landholders for the loss of their property.
Following India's independence, the government adopted "The Land Acquisition Act, 1894" as a legal framework for acquiring land. The Constitution of India initially guaranteed the right to property under Articles 19 and 31. Both the State and Central Governments were empowered to requisition property under Schedule VII, Entry 42, List III of the Constitution. However, the 44th Constitutional Amendment Act of 1978 altered this by making the right to property no longer a fundamental right, although it remains a constitutional right.
With the liberalization of the economy, the government introduced initiatives such as Special Economic Zones. These efforts aim to provide fair compensation and rehabilitation for families affected by land acquisition, ensuring that the impacted individuals benefit from development and experience improved social and economic status post-acquisition.
This book, now in its Tenth Edition, has been thoroughly revised to reflect the new legislation while considering the repealed Act. It is divided into two volumes: Volume I covers Sections 1 to 63, and Volume II covers Sections 64 to 114 and the Schedules. Additionally, it includes rules framed by both the Central and State Governments, policies, and related acts, making it a comprehensive legal treatise on the subject. A new feature included in this edition is a "Table of Time Frames," outlining key timelines in accordance with the provisions of the Act, which is not found in other books on the subject.
