An affidavit is a voluntary written declaration made by a deponent (the person making the affidavit), signed and accompanied by a notary or authorized witness to verify the authenticity of its contents. The term "affidavit" originates from a Latin word meaning "to pledge one's faith." It is signed and attested to confirm the genuineness of the deponent's signature or identity by a notary authority. Unlike depositions, which are compulsory, affidavits are voluntary. Essentially, an affidavit can be seen as a written equivalent of sworn testimony given in court, as both are made under oath. However, while oral testimony is only admissible in court, affidavits have numerous applications outside the courtroom.

Notably, providing false information in an affidavit can lead to perjury charges against the deponent, except in cases of genuine memory lapses. The notary or verifying authority must certify the affidavit, mark and initial exhibits, and sign the certificate, including their full name and official designation. Each affidavit should be clearly structured, with statements of fact divided into numbered paragraphs, each focusing on a specific part of the subject matter.

For individuals other than plaintiffs or defendants, affidavits should include identifying details, such as full name, father's name, profession or trade, age, and residence, to clearly establish the identity of the deponent.
