Sri's comprehensive examination of this difficult area of insolvency law, looking not only to our jurisdiction but also to others for knowledge and answers to what the law is, how it is practised, and how to navigate its procedural labyrinth, will benefit both the individual and the institution.
From the Foreword by
Dato’ Mary Lim Thiam Suan
Judge of the Federal Court of Malaysia
The Story of the Book
The Insolvency Act of 1967 (Act 360), as revised by the Bankruptcy (Amendment) Act 2017, is the basis for this book (Act A1534). It is designed to serve as a handbook for lawyers, students, judicial officers, Department of Insolvency officers, and anyone involved in insolvency processes. Personal Insolvency Law In Malaysia gives a thorough overview of personal insolvency law and discusses the eight acts of bankruptcy outlined in the Insolvency Act of 1967. It discusses bankruptcy notice and petition procedures, as well as the voluntary agreements possible in bankruptcy. It goes over the bankruptcy order as well as the bankrupt's disqualifications and limitations. The book also discusses how a bankrupt can be discharged or the bankruptcy order cancelled, as well as appeals and stay procedures related to the bankruptcy order.
This book provides a clear and organised description of the practise of insolvency law in Malaysia. It is concise yet thorough, with discussions fully supported by statute and case sources.
