Domestic arbitral statutes and the New York Convention make arbitration the ultimate dispute resolution process used both locally and globally. The United Nations Commission on International Trade Law (UNCITRAL) has published the Model Law on International Commercial Arbitration for countries to adopt, as well as the Arbitration Rules for arbitral institutions and parties to utilise. The UNCITRAL Model Law has received widespread support. It has been adopted in 80 States and 111 jurisdictions to date, with domestic legislation following the UNCITRAL Model Law provisions for guidance and direction. It is shown by the Malaysian Arbitration Act 2005 (Amended 2011 and 2018).
Similarly, for ad hoc arbitrations, the UNCITRAL Arbitration Procedures are the most often utilised rules. The 2018 Arbitration Rules of the Asian International Arbitration Centre (AIAC) are based on the UNCITRAL Arbitration Rules, with required changes.
This book presents a detailed analysis of each article of the UNCITRAL Model Law or the comparable portions of the Malaysian Arbitration Act 2005 (Amended 2011 and 2018), backed up by Malaysian and international cases, particularly from Model Law jurisdictions.
