Comprehensive Guide to the Roles, Powers and Practices of Commissioners for Oaths.

Misunderstandings concerning the authority, responsibilities and functions of Commissioners for Oaths (CFOs) remain prevalent among the public. Even within the profession, differing interpretations of the extent of their powers and jurisdiction have contributed to uncertainty and confusion. While affixing an official seal may appear to be a straightforward administrative task, it involves the exercise of professional judgment and a thorough understanding of the relevant circumstances, the purpose of the transaction and the legal requirements governing the administration of oaths, affirmations and other formal declarations.

This comprehensive publication provides an authoritative examination of the legal framework, professional practices, duties and obligations of Commissioners for Oaths in Malaysia. It explores essential aspects of the profession, including appointment procedures, statutory powers, professional ethics, regulatory compliance, document administration, financial management and emerging challenges. The book also incorporates comparative perspectives on related legal office holders and practices in selected international jurisdictions, offering valuable insights into the broader legal and professional context.

Designed to support both aspiring and practising Commissioners for Oaths, this publication serves as a practical handbook for newly appointed officers and a reliable reference for experienced professionals. It identifies the relevant legislation and prescribed forms, explains the technical procedures involved in administering oaths and affirmations, and provides guidance on the proper execution and authentication of documents. Particular emphasis is placed on clarifying the lawful scope of a Commissioner's authority to ensure that official duties are performed accurately, responsibly and in accordance with applicable legal requirements.
