“The importance of this book extends beyond the immediate interests of practitioners. Tribunals increasingly form part of the public’s interaction with the justice system. A proper understanding of their jurisdiction, procedures, powers, and limitations is therefore relevant not only to members of the legal fraternity, but also to academics, students, litigants, and members of the public. By bringing together in a single volume the principal legal and procedural considerations governing tribunal proceedings from the commencement of a claim to its determination, the making and enforcement of an award, and the avenues of appeal and judicial review, the book provides a useful and accessible reference to this important area of Malaysian law.”

— From the Foreword by:
Dato’ Seri Vazeer Alam bin Mydin Meera
Judge of the Federal Court of Malaysia

Tribunals: Process and Procedure offers an extensive analysis of the various tribunals established in Malaysia and their growing significance in providing accessible, efficient and affordable avenues for justice. As tribunals continue to develop across different areas of law, they play an essential role in complementing the conventional court system by offering specialised mechanisms for resolving disputes. Unlike traditional court proceedings, tribunal processes are generally more flexible, less formal and easier to navigate, allowing parties to seek remedies without the complexities and costs often associated with litigation.

Structured into 20 chapters, this publication examines both the theoretical principles and practical aspects of Malaysia's tribunal system. It begins by exploring the relationship between courts and tribunals, distinguishing the adversarial nature of conventional litigation from the more inquisitorial procedures frequently adopted by tribunals. The discussion further addresses the objectives behind establishing tribunals, their position within the wider dispute resolution framework and the importance of maintaining a balance between procedural fairness, accessibility and efficiency.

The book provides detailed coverage of major Malaysian tribunals and specialised adjudicative bodies, including those responsible for consumer disputes, homebuyer claims, anti-sexual harassment, anti-bullying, gig worker matters, strata management, competition law, copyright disputes and taxation. It also examines essential procedural considerations, including the initiation of claims, hearing procedures, admissibility and evaluation of evidence, legal representation, the application of judicial precedents, enforcement of tribunal awards, judicial review and appeals to the High Court.

Combining authoritative legal analysis with practical insights, this publication provides a thorough understanding of the jurisdiction, statutory powers, responsibilities and procedural requirements governing tribunals in Malaysia. It is a valuable reference for legal practitioners, in-house legal advisers, law students, academics, policymakers, tribunal members and individuals seeking a comprehensive understanding of Malaysian tribunal law and dispute resolution procedures.
