The Adoption Ordinance 1960 (Sabah No. 23 of 1960) is Sabah’s primary legislation governing the legal adoption of children. Introduced in 1960, it provides the framework for how a person or couple may legally adopt a child, ensuring that the adoption serves the best interests of the child. The Ordinance sets out the eligibility of adoptive parents, requirements for consent from biological parents or guardians, and mandates court approval for all adoptions. Once finalized, the adopted child acquires full legal rights and obligations as if a natural child of the adoptive parents, and the rights of the biological parents are terminated. The law also accommodates special cases, including abandoned children or those with unknown parents, and protects the welfare and legal status of children throughout the adoption process.
