This book explores the nature of judicial work—what judges actually do in their daily roles. Its focus is on the practical realities of judging in civil law cases, from higher courts to those handling smaller disputes.
Part I examines three core judicial values—independence, impartiality, and integrity—and discusses how these principles influence day-to-day judicial practice. Topics include judicial guidance and codes of conduct, institutional safeguards that protect judicial independence, and behavioural expectations for judges both inside and outside the courtroom.
Part II shifts to the practical aspects of judging, addressing the legal and policy frameworks within which judges operate, the skills and techniques of judging (judgecraft), and the process of judicial decision-making. It considers issues such as judicial appointments, working conditions, fact-finding, self-represented litigants, delivering judgments orally (ex tempore), and the interpretive practices used when applying legislation and precedent.
The book also highlights that a judge’s responsibilities extend beyond making rulings to include case management and, for those in leadership roles, overseeing colleagues and judicial administration. Furthermore, it examines how increasing caseloads have led to more routine processes, intuitive judgments, and a shift toward written, paper-based decisions rather than oral hearings.
Rather than offering a philosophical or theoretical account of judging, this book draws upon judicial experience and social science research to present an empirical picture of what judges actually do.
